TechCrunch reports that researchers used AI on spectrogram images of cockpit recordings to reconstruct the voices of pilots who died in crashes, forcing the NTSB to temporarily shut down its docket system. Meanwhile, a paper out of arXiv, 'The Shape of Testimony', proposes a scalable AI framework for comparing oral history archives, specifically Holocaust survivor testimonies. Both projects involve AI animating voices that can no longer consent.

Digital Resurrection and the Consent Vacuum

The cockpit reconstruction case is legally murky because the recordings exist in a public docket. The survivors' oral histories exist to be preserved and studied. But in both cases, AI does something that feels categorically different from transcription or analysis: it performs the voice. It makes the dead audible again in a register that is viscerally, uncomfortably alive. A 2022 paper in AI and Society by Stacey Pitsillides found that digital afterlives create grief complications for the living precisely because they feel too real. The pilots' families did not ask for this. The Holocaust survivors who gave testimony in the 1980s could not have imagined it.

When Archives Become Actors

Google's new anything-to-anything Gemini model, capable of synthesizing across modalities with startling fluency, makes the technical barrier to this kind of reconstruction essentially zero. What remains is institutional. The NTSB's response, blocking access entirely, is a blunt instrument. It suggests our governance frameworks are nowhere near as sophisticated as our reconstruction tools. The oral history project at least frames its AI use as comparative and structural, not performative. But the line between those two is thinner than any IRB board has yet acknowledged. As AI gets better at voice, the question shifts from can we to whose permission do we need, and from whom is it impossible to get.
